Terms & Conditions Martin N Callan Legal Document Service is not responsible for the content, quality or appropriateness of any third party product or service available through this site. “We/us/our”: Martin N Callan Commissioner for Oaths (“The Company”) “You/your”: You (“The Client”) “Business Days”: A normal working day, excluding Bank Holidays or other National holidays from time to time followed “Final Response”: Our final decision in any complaint “Holding Response”: Our interim decision in any complaint “Swearing Fee”: The fee paid by You “Assessment Process”: Our process by which We assess any documents served on you so as to determine whether they are properly sworn or attested. 1. General Principles We will:- a) Act fairly and reasonably in all dealings with you. b) Ensure that any service offered is one that meets Your needs c) Ensure that all information given to you is clear, transparent, fair and not misleading. d) Avoid conflicts of interest. e) Preserve your confidentiality unless disclosure is required or permitted by law or by the you. We will abide by the Data Protection Act 1998 and any and all subsequent regulations or legislation derived from the said Act. 2. Services 2.1 We will provide the following types of service to You: 2.1.1 Guidance and help completing documents or forms by telephone 3. Complaints In the event of a complaint, our procedures are: - 3.1 Complaints may be made in writing; by e-mail, by telephone or in any other form in respect of a service that We have provided Compliance Manager Martin Callan Limited 54 Academy Place Isleworth London TW7 5FD 3.2 We reserve the right to decline to consider a complaint that is made more than six months after you became aware of the cause of the complaint. There may be instances where We will waive this requirement, but this is strictly at our discretion. 3.3 We will confirm to you in writing if a complaint has been made outside the time limit that we are prepared to consider. 3.4 We will send you a written or electronic acknowledgement of a complaint within five Business Days of receipt, identifying the person appointed who will be handling the complaint for You. 3.5 Wherever possible, the person identified as appointed in Clause 3.3 will not have been directly involved in the matter which is the subject of the complaint, and will have authority to settle the complaint. 3.6 Within four weeks of receiving a complaint, we will send you either: a) A Final Response which, in our opinion, adequately addresses the complaint; or b) A Holding Response, which explains why we are not yet in a position to resolve the complaint and indicates when we will make further contact with you. 3.7 Within eight weeks of receiving a complaint we will send you either: a) A final response which, in our opinion, adequately addresses the complaint; or b) A response which: i) Explains why we are still not in a position to make a final response, giving reasons for the further delay and indicating when We expect to be able to provide a final response; and ii) Informs you that You may refer the handling of the complaint to the Claims Management Regulator if you are dissatisfied with the delay. 3.8 Where we decide that redress is appropriate, we will seek provide you with fair compensation for any acts or omissions for which we are responsible and will comply with any offer of redress, which you accept. Appropriate redress will not always involve financial redress. 3.9 If you are not satisfied with the final response you have the option to refer the matter to the Instiutute of Legal Executives who regulate Martin Callan as a Legal Executive Lawyer. Martin Callan is a Fellow of the Institute of Legal Executives and is bound by the Code of Conduct. The Code of Conduct relates primarily to the provision of legal services to clients but Martin Callan has sought to import the principles of the Code into this business to ensure customers receive high standards and have a process for redress if they are unhappy with the final decision of any complaint. In order for us to process Your claim efficiently, you are required: 4.1 To provide us promptly with all relevant information and items we request to enable us to attest a Swearing or advise on the lawful attestation of sworn documents served on you. 4.2 To provide us with clear and precise instructions. 4.3 To co-operate with us 4.4 Not to ask or expect us to work in an improper or unreasonable way or to mislead us. 4.5 To read all of our terms and conditions and sign the attached disclaimer to agree that you have read and understood them. 5. Cancellation You may cancel this contract and the following outlines the circumstances and the consequences of cancellation, which are.- 5.1. Cancellation by You: 5.1.1 You may cancel this Contract (subject to Clauses 5.1.2 and 5.1.3) at
any time by writing to us at: Martin Callan Limited 54 Academy Place Isleworth London TW7 5FD 5.1.2 If you cancel this Contract any Fees paid for the service at the time of cancellation will not be refunded. 5.2 Cancellation by US: 5.2.1 We may cancel this Contract at any time by giving you written Notice and in doing so will take into consideration Clauses 5.2.2 and 5.2.3, below. 5.2.2 We will warn you if we intend to charge such fees and how much they are likely to be. 5.2.6.1 If you have breached your obligations as set out in Clause 4, we may cancel this agreement. 5.2.6.2 If you accept an offer that we consider inadequate or reject an offer that we consider to be reasonable we may cancel this Contract. 5.2.6.3 Cancellation of this Contract by either party must be in writing. 6. Other Provisions 6.1 This Contract is governed by the Law of England & Wales 6.2 The Contracts (Rights of Third Parties) Act 1999 shall not apply to (and no person other than the Parties or their lawful successors in title shall be entitled to enforce) any of the provisions of this Contract. 6.3 We reserve the right to vary, amend, change or otherwise alter the substance and/or (but not limited to) the context of the Clauses of this Contract. In the event that we exercise this discretion, we will notify you of the variation. 2.2 We will not provide any advice of a legal nature or any advice relating to the appropriateness, potentiall success, relevance or any other form of advice whatsoever in relation to the nature, form and content or consequences of the form or document being completed.
2.3 The fees charged for the services referred to in 2.1 are:
2.3.1 For telelphone appointments - you will be charged 50 pence per minute and will telephone us at the time of the appointment. This is the standard rate from a BT Landline (network charges may vary).
2.3.2 For face to face appointment - you will be charged £50 for a full hour, plus any travel expenese if you live outside of London. You will be required to pay the fee at the commencement of the appointment.
